Federal High Court Affirms Adron Homes Estate Management Rights

In a resounding legal victory for Adron Homes, the Federal High Court sitting in Abeokuta, Ogun State, has dismissed a suit filed by the Registered Trustees of the City of David Residents Association (CODRA) alongside Elder Gbadebo Aromolaran, Mr. Adetokunbo Adeshile, Mr. Olaolu Ayinde, Olusegun Aba Yomi Esq, and Oluwadamilare Awokoya Esq against Adron Homes and Properties Limited.

The case, numbered FHC/AB/FHR/58/2023, was presided over by Hon. Justice Abiodun J. Adeyemi, who, after a comprehensive review of the claims and evidence presented, found the applicants’ allegations against Adron Homes to be unsubstantiated, speculative, and devoid of merit.

The applicants had accused Adron Homes of infringing on their right to personal liberty, but the court held that no credible evidence was provided to show that the company posed any threat or engaged in any act constituting a breach of their fundamental human rights.

Justice Adeyemi stated that there was no record of any invitation, arrest, or action attributable to Adron Homes that could substantiate such claims. He further noted that the allegations amounted to mere speculation unsupported by facts.

On the issue of proscription and infringement of the right to freedom of association, the court ruled that Adron Homes has no authority to proscribe CODRA or prevent residents from associating. However, it clarified that while residents are free to form associations, the legal right to own, manage, and make administrative decisions concerning the estate rests solely with the company as the legitimate developer and manager.

The court emphasized that its ruling was based strictly on evidence and the law, not on conjecture or personal interpretation. Consequently, the case was dismissed in its entirety.

Adron Homes, in its reaction, described the judgement as a victory not just for the company but for all its subscribers and residents, reiterating its unwavering commitment to their welfare, satisfaction, and the consistent delivery of value.
